Communications Compliance Policy

This Communications Compliance Policy applies to email, SMS, phone, and other messages sent through Ruunly.

1. Sender Responsibility

If you send messages through Ruunly, you are the sender of those messages. You are responsible for the message content, recipient list, consent, timing, required disclosures, opt-out handling, and legal compliance.

Ruunly provides software and delivery infrastructure. Ruunly may also enforce platform, provider, carrier, and legal requirements.

2. Consent and List Quality

You may message only recipients you are legally permitted to contact. You must not upload or use:

  • Purchased, rented, scraped, harvested, appended, or borrowed lists
  • Lists collected by another business without valid transfer rights
  • Recipients who opted out, revoked consent, or asked not to be contacted
  • Numbers or addresses collected through misleading forms
  • Numbers from lead generators unless the consent specifically authorizes messages from your business and satisfies applicable law

You must keep records showing when, where, how, and for what purpose each recipient consented.

3. Email Requirements

Commercial email must comply with CAN-SPAM and similar state laws. Each commercial email must:

  • Use accurate From, To, Reply-To, domain, and routing information
  • Use a subject line that accurately reflects the message
  • Identify the message as advertising where required
  • Include the sender's valid physical postal address
  • Include a clear and working unsubscribe method
  • Allow recipients to opt out without paying a fee, logging in, or providing information beyond an email address
  • Honor opt-outs within 10 business days or sooner where required
  • Keep the unsubscribe mechanism working for at least 30 days after the email is sent

Transactional or relationship email must not use false or misleading routing information. If a message mixes transactional and promotional content, it may be treated as commercial email and must include commercial email disclosures and opt-out.

4. SMS Requirements

You may send SMS only where you have the required consent and legal basis.

Promotional or marketing SMS requires prior express written consent. The consent must clearly authorize your business to send marketing texts to the recipient's phone number using automated technology, and it must state that consent is not required as a condition of purchase.

Transactional or informational SMS requires at least prior express consent and must stay limited to the transaction or relationship that prompted consent. Do not add marketing content to a transactional text unless you have marketing-level consent.

Each SMS program must provide clear opt-out instructions. You must honor opt-out requests made by reasonable means, including replies such as STOP, CANCEL, END, QUIT, REVOKE, OPT OUT, or UNSUBSCRIBE. Ruunly may treat similar replies as opt-outs where a reasonable person would understand them as revocation.

5. Message Content

Messages must be truthful, not misleading, and must identify the sender. You may not send messages that:

  • Are illegal, fraudulent, deceptive, harassing, hateful, threatening, or abusive
  • Contain phishing, malware, credential collection, or impersonation
  • Advertise prohibited goods or services
  • Violate Stripe, Telnyx, Resend, carrier, CTIA, or Ruunly rules
  • Use SHAFT content for SMS unless expressly allowed by carrier rules and Ruunly in writing
  • Contain sensitive health, financial, government ID, or children's data unless legally permitted and approved by Ruunly

6. Quiet Hours and Frequency

You must comply with federal and state restrictions on call and text timing, including local-time quiet hours for telemarketing. You must not send excessive, unexpected, or abusive message volumes. Ruunly may impose frequency caps, rate limits, batching, throttling, and review.

7. Suppression Lists

Ruunly may maintain unsubscribe, STOP, bounce, complaint, and suppression records. You must not delete, bypass, re-upload, or override suppression records except to correct a documented error. If a recipient opts out outside of Ruunly, you must update Ruunly before sending more messages.

8. Imported Customers

Before importing customers for messaging, you must certify that:

  • The contacts were lawfully collected
  • You have an existing business relationship or other lawful basis for the intended message
  • The list excludes people who opted out
  • You can provide consent records if requested
  • You will comply with this Policy

9. Monitoring and Enforcement

Ruunly may monitor metadata, delivery results, complaints, bounces, opt-outs, carrier responses, and message samples to enforce this Policy. Ruunly may block messages, pause campaigns, suspend messaging, require proof of consent, or terminate accounts that create legal, deliverability, carrier, abuse, or reputational risk.
